1. Overview of Terms

We are the creators of the Roam smart tracker products and operate under the company name BuckleBeats Limited  ("Roam smart tracker", “Roam Loop”, “Roam”; “we”, “us” or “our”), a company registered in England and Wales. Our company registration number is 15028423 and our registered office is 132a High Street Bromsgrove, UK, B61 8ES and will be trading in the UK, EU, USA, Canada, Australia, and other regions as applicable. Our company details are set out at the end of this Terms and Conditions document (these “Terms”).

2. QR Code Service

  • QR Code Registration and Functionality: The Roam QR code service allows you to register a QR code to a product (e.g., bike, laptop, etc.) and add relevant details such as the item’s name, category, and contact information. This information is stored in the user’s online profile and is linked to the QR code.

  • Lost Mode: If the item is lost, the user can enable "Lost Mode," which allows the QR code to display the contact information and details when scanned by someone else. If "Lost Mode" is not activated, no information will be shared upon scanning the QR code.

  • Geo-Location Tracking: Upon scanning a QR code in "Lost Mode," the scanner is asked for consent to share their geo-location (via their mobile phone) to help locate the lost item. If consent is given, an email notification will be sent to the registered user, including the geo-location of where the item was scanned. The accuracy of the geo-location depends on the third-party service what3words.

  • External Third-Party Services: The Roam QR code service uses external services for geo-location tracking (what3words), email notifications (Brevo, formerly Sendinblue), and hosting (Digital Ocean and Cloud 66). These services may have access to the data required to provide these functionalities, but Roam ensures that they are used in compliance with applicable privacy laws.

  • User Rights: You can update or delete the information linked to your QR code at any time via your profile. The information stored on the QR code is personal to the user and can be edited or removed entirely. Roam does not sell or transfer your personal data to third parties for marketing or tracking purposes, except as necessary for providing the service (e.g., using Brevo for email notifications).

  • Subscription Levels: The basic QR code registration service is free. However, certain advanced features, such as multi-user account access or additional tracking functionalities, are only available through premium subscription plans.

3. Privacy and Data Protection

  • Data Processing and Privacy Compliance: Roam is committed to ensuring the privacy and security of your personal data. By using the Service, you consent to the collection, processing, and storage of your personal data as outlined in our Privacy Policy. Roam adheres to relevant privacy laws such as GDPR (EU), CCPA (USA), and PIPEDA (Canada), among others.

  • Data Location: Roam stores data in centralized servers. However, depending on the jurisdiction, data may be processed in different regions, and certain data may be hosted by third-party services (e.g., Digital Ocean for hosting and Brevo for email notifications). We take appropriate steps to ensure that your data is protected, in compliance with applicable laws such as GDPR, CCPA, etc.

  • User Rights: As a user, you have the right to access, correct, or delete your personal information at any time. You may also request a copy of your data in a portable format. For more details on how we process your data, please refer to our Privacy Policy.

4. Subscriptions, Payments, and Refunds

  • Subscription Plans: Roam offers both monthly and yearly subscription plans for premium features related to the QR code service (e.g., additional tracking features, multi-user access). The pricing for each plan is displayed in the currency applicable to your location.

  • Auto-Renewal: By subscribing to our premium service, you agree that your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the applicable rate at the time of renewal.

  • Refunds: You may cancel your subscription at any time. For monthly subscriptions, you are eligible for a full refund within 14 days from the subscription date. For yearly subscriptions, refunds are available within 30 days of subscription. No refunds will be provided after these periods, and refunds are not applicable for partial months of service.

  • Taxation and Fees: Subscription fees and other charges may include applicable sales tax, VAT, or similar taxes based on your location. Users are responsible for any additional taxes or duties imposed by their local jurisdiction. Roam will provide a tax breakdown during the payment process, and the final price will reflect the applicable taxes.

5. User Conduct and Prohibited Activities

  • Acceptable Use: You agree to use the Service solely for lawful purposes and in compliance with all applicable laws and regulations. This includes not using the Service to engage in any fraudulent activity, harassment, or infringement of intellectual property rights.

  • Prohibited Activities: You may not use Roam’s website, app, or QR code service for the following:

    • Creating false or misleading QR code profiles

    • Attempting to access or track another user’s QR code without permission

    • Uploading harmful content such as viruses, malware, or fraudulent information

  • Violation of these terms may result in the suspension or termination of your account without refund.

6. Liability and Disclaimers

  • Disclaimer of Warranties: Roam provides the Service on an "as-is" basis, without warranties of any kind, either express or implied. We do not guarantee that the QR code service will meet your expectations or that it will be uninterrupted, secure, or error-free.

  • Limitation of Liability: To the fullest extent permitted by law, Roam is not liable for any indirect, incidental, or consequential damages, including loss of data, profits, or QR code functionality. Our total liability is limited to the amount paid for the Service in the 12 months prior to the claim arising.

  • Third-Party Services: Roam may rely on third-party services for aspects of the QR code tracking and location services. Roam disclaims responsibility for any inaccuracies or service disruptions caused by these third parties.

7. Shipping and Delivery

  • Shipping Policies: If you purchase physical devices (e.g., Roam smart trackers), shipping policies will vary depending on the country of delivery. Delivery timeframes, customs duties, and returns are subject to each country’s specific terms and conditions.

  • Customs and Duties: Users are responsible for any customs duties or taxes applicable to their purchases. Roam will make reasonable efforts to provide estimated delivery times and inform users of potential customs duties during the checkout process.

  • Returns: If you are not satisfied with your Roam product, you may return it in accordance with the Return and Refund Policy provided at the time of purchase.

8. Governing Law and Dispute Resolution

  • These Terms are governed by the laws of England and Wales. Disputes arising under these Terms shall be resolved in the courts of England and Wales, except where the laws of another jurisdiction provide higher consumer protection standards.

9. Changes to Terms

  • Roam reserves the right to update these Terms at any time. Any changes will be communicated to you via email or through a notice on the Service. Your continued use of the Service after such changes will signify your acceptance of the revised Terms.

10. Privacy and Data Compliance

  • Roam’s commitment to privacy extends across all regions, ensuring compliance with local data protection laws, such as the General Data Protection Regulation (GDPR) in the EU, California Consumer Privacy Act (CCPA) in the USA, Personal Information Protection and Electronic Documents Act (PIPEDA) in Canada, and other applicable regional privacy laws. Roam will process and store your data in compliance with these regulations and provide the necessary tools for you to exercise your data protection rights.
